By accessing or using our website at www.chrono-watch.com and any other websites we own or operate from time to time (collectively, our Website), you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions (Terms and Conditions) and our Website Use/Purchase Policies (Policies). We reserve the right to add, delete, modify, or otherwise alter any or all of our Terms and Conditions and Policies at any time without further notice, at our sole discretion. It is your responsibility to check our Website to determine the then-current Terms and Conditions and Policies to which you are bound. If you do not agree to abide by these or any future Terms and Conditions or Policies, do not use or access, or continue to use or access, our Website.

The Chrono Watch name and logo, pictures, graphics, as well as our Website itself are protected by copyright, trademark, and/or other intellectual property laws (Intellectual Property). You may not use our Intellectual Property without our prior written consent.

Our Website may contain Content and other Intellectual Property owned by third parties or protected by copyright, trademark and other intellectual property rights of third parties (Third Party Property). We do not independently verify the business practices of these third parties, and we make no representations and warranties regarding any Third Party Property. The availability of any link or reference of any third party shall in no way constitute an endorsement by us of such third party or by such third party of us.

We are not an authorized dealer of any brand name watch manufacturer, and we are not affiliated with any such manufacturers, their authorized dealers or distributers or owners of Third Party Property. As such, we disclaim any and all proprietary interest in Third Party Property unless otherwise stated in writing.

 

ERRORS AND INACCURACIES

Our goal is to provide accurate and up-to-date information on our Website. However, our Website may contain typographical mistakes, inaccuracies, errors or omissions, and some information may not be complete or current. We reserve the right to correct any mistakes, inaccuracies, errors or omissions, including after an order has been submitted, and to change or update information at any time without prior notice. We will not be liable to you for any mistakes, inaccuracies, errors or omissions on our Website.

 

DISCLAIMER OF WARRANTIES

Unless expressly stated in our Watch Warranty Policy, we disclaim all representations and warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement in respect to our Website, watches and other items we sell. You expressly understand and agree that your use of our Website is it at your sole risk and that our Website is provided on an as is and as available basis. No advice or information, whether oral or written, obtained by you from us or our Website shall create any warranty not expressly stated in the Watch Warranty Policy or in these Terms and Conditions.

 

AGREEMENT FORMATION

The products displayed on the website are not offers but invitations to make offers, and a final agreement is not made until you have received an order confirmation and paid a deposit. Once you have found a product you wish to purchase, you can send your request to purchase that specific product to Chrono Watch. You will be contacted with an order confirmation on the terms that Chrono Watch can offer you. The offer is accepted by you when you make the deposit.

Please note that Chrono Watch does not accept cash payments, only bank transfers

 

DELIVERY

Chrono Watch offers personal delivery throughout Europe. If you wish for personal delivery, you will need to present identification documents that include your address before entering into the agreement, and the full amount must be paid to Chrono Watch. The specific delivery terms are always agreed upon individually.

 

RIGHT OF WITHDRAWAL

As a business, you have no rights of withdrawal.

Your right of withdrawal as a consumer depends on whether the products are in stock or sourced :

1. In-stock items

• 1.1 As a consumer, you have a 14-day right of withdrawal from the moment you receive the watch.
• 1.2 Out of the price you pay for the watch, Chrono Watch incurs costs of DKK 3,500.00 for delivery costs, security handling costs, marketing, etc. Therefore, an amount of DKK 3,500.00 will be deducted from all refunded amounts for watch purchases.
• 1.3 To exercise your right of withdrawal, you must provide written notice within the 14-day period. You must include your name, address, order details, phone number, and email address. The written withdrawal must be sent to info@chrono-watch.com.
• 1.4 The product must be returned in its original packaging, unused, and in the same condition as when received. All documents and proofs, etc., must be intact and included. The consumer must pay for the return shipment as well as any insurance.
• 1.5 The return address is Chrono Watch ApS, Strandvejen no. 100, 2900 Hellerup, Denmark.
• 1.6 You must use a secure and traceable return method, and we recommend insuring the shipment for the full value of the product. Chrono Watch assumes no responsibility for products damaged or lost in connection with the return shipment. All returns can be made in person at the office.
• 1.7 You are responsible for any decrease in the product's value if you have handled the product in a way other than necessary to determine its nature, characteristics, and functioning. You may not have used the product, even just wearing the watch at home.
• 1.8 If the product has been handled beyond what is described above, it is considered used, which means that upon withdrawal of the purchase, you will only receive a partial or no refund depending on the commercial value of the product.

2. Sourced items

• 2.1 Note that the right of withdrawal does not apply to products listed as sourced items. As a consumer, you have no right to use the right of withdrawal for these products.
• 2.2 All purchases of products listed as sourced items are final once the agreed deposit is paid. By paying the deposit, you waive any right to return the ordered watch.
• 2.3 When you purchase a sourced watch through Chrono Watch, you are acquiring a service, a warranty, and a watch. The service consists of Chrono Watch finding and purchasing the specific watch you request from its network of dealers. These are special exclusive items on order, which cannot be sold to other customers without incurring losses. The warranty is obtained specifically for the ordered watch, and the warranty period is activated for you.
• 2.4 The product is considered used when the seal is broken, the watch is worn for the first time, and/or the strap/bracelet is adjusted. The broken seal, adjusted strap/bracelet, and any accompanying signs of use also mean that the product cannot be returned to Chrono Watch in the same condition, as it can no longer be resold as new.

 

WARRANTY

Chrono Watch exclusively sells authentic watches that have been sold by authorized dealers to either individuals or watch dealers. For repair work and other services covered by the manufacturer's warranty, you should contact the nearest authorized dealer. Chrono Watch can assist in submitting the product for service if it is covered by the warranty. Some of the products sold on the Chrono Watch website come with a manufacturer's warranty. Refer to the accompanying materials from the manufacturer for further details.

 

GOVERNING LAW AND VENUE

By visiting or using our Website or by purchasing any item from or through us, you agree that the laws of Denmark, without regard to principles of conflict of laws, will govern these Terms and Conditions, our Policies, any purchase and sale transaction between you and us and any dispute arising from any of the foregoing. You consent and agree that any dispute between you and us shall be litigated exclusively in the Danish Court for Commerce. You hereby irrevocably consent to the exclusive venue and jurisdiction of such danish courts, and agree to accept service of process by mail, and hereby waive any jurisdictional or venue defenses available to you, including, but not limited to, inconvenient forum.
